Circulation Conduct Complaints Procedure

Disclaimer: We are striving to bring you the safest festival possible, these policies are still under review and we will be continuously working to make these policies the best and most up to date they can be.

Circulation Festival is a Right Of Admission Reserved (R.O.A.R) event, meaning the event organisers have the right to remove anyone from the event  for any reason. This responsibility is taken very seriously by Circulation Community Inc. 

All incidents will be taken seriously and will be looked into by the Circulation Conduct Committee [CCC], which is made up of;  three committee members, the on duty site manager and anyone else deemed appropriate at the time by the Circulation committee.

All incidents that are recorded will be done so on paper in the official incident log which is kept in a location that can not be accessed by anybody not in the conduct committee.

Examples of behavior Circulation Community Inc deems unacceptable include but are not limited to:

  • Dangerous intoxication levels: Circulation Festival is an all ages, family friendly event. We do not condone the misuse of alcohol or drugs and we will not tolerate any unacceptable behavior related to the substances.

  • Disrespecting other participants and/or their property: Examples for this include taking other people's property without permission, theft, ignoring personal boundaries, destruction of another participants property/props and or that of Waiora Scout Camp.

  • Aggressive/intimidating behaviour: We at Circulation have a zero tolerance policy for sexual/physical abuse and harassment.

  • Non-compliance with Circulation policies or the instructions of the festival organisers.

Responses:

Circulation Community Inc is responsible to strive for the safety and well-being of participants at Circulation Festival and as such may have a variety of responsibilities if an incident occurs.

At the lowest end of the response spectrum include; talking to and recording incidents for future reference, talking to affected parties and following up with affected peoples during the event (including minor first aid).

At the extreme end of the responses can include; removing someone's right to attend the event and requiring them to leave immediately or ringing emergency services on behalf of the event organisers to deal with any situations they deem necessary. 

Below is a description of the process for investigating an incident to determine an outcome.

  1. When an incident report is lodged, the Circulation Conduct Committee [CCC] chooses if they are going to carry out the investigation immediately or if they will use an outside external organization for assistance. These external organisations can include but not limited to; emergency services, mediation services, mental health organisations and legal services. We endeavour to have at least two members of the CCC present as soon as possible.

  2. If we are aware of a complaint we will contact the person affected and enquire about their wishes and how they would like the conduct committee to proceed. Their well-being and safety holds top priority and no steps will be taken without their consent, unless a crime has been witnessed in which case the police will be called immediately.

  3. We will ask the person affected to write a written statement and our team will offer to assist them in the recording of the incident. If this report is able to be taken on site it will be physically recorded in the incident book which will be kept in a location only accessible to the conduct committee.

  4. If the person affected wishes that the incident report be taken further the Conduct committee will make contact with the person in question. If the person in question is unwilling to engage with the conduct officers then it is up to the conduct committee to discuss an outcome best suited to the person affected and the event as a whole. Failure to engage with the CCC could result in removal from the event.

  5. If the person in question successfully engages with the conduct officers but has an alternative view on the situation at hand, our conduct committee will offer the person in question and the person affected an external mediation process. If either party is unwilling to engage then an outcome will be jointly negotiated within the three parties. If the resolution is satisfactory to all parties then the initial report will be archived.

  6. If the person in question successfully engages with the conduct officers but has an alternative view on the situation at hand, our conduct committee will offer the person in question and the person affected an external mediation process (mediation is situation dependant and is only conducted with the consent of the person affected). If either party is unwilling to engage then an outcome will be jointly negotiated within the three parties. If the resolution is satisfactory to all parties an initial report will be archived. 

  7. Serious and/or repeated offences will call for a more restorative justice process. The person in question may be referred on to an external service for additional support in conjunction with any bans or removals. The purpose of this action is not to persecute the person in question but to encourage accountability and a change in toxic behaviours.

  8. Removal from the event does not constitute an automatic ban from future events unless stated and presented in writing by the CCC . Appeals can be made however this will be decided on at a separate meeting of the Circulation Community Inc committee.

At any point during the process we might find it suitable to refer individuals to OCASA as part of a restorative justice, counselling and external mediation process. referrals@ocasa.org.nz

In order to complete a referral OCASA requires us to provide;

  • Client name

  • Client DOB/ age

  • Client consents to/ wants contact from OCASA

  • Contact details provided (e,g, phone number, email)

  • Is it ok to leave a voice message or text message? (yes/no)

Important information:

  • OCASA will be in contact with the referrer if the referral is incomplete e.g. if consent to contact OCASA is not indicated.

  • OCASA accepts referrals for individuals aged 16 years and over.*

PLEASE NOTE THE FOLLOWING:

  • Support, social work and counselling are available to individuals aged 18 years+

  • For individuals aged 16-18, we will provide initial single session support, and a referral to an appropriate service specialising in work with young people.

  • OCASA is happy to support parents of survivors aged under 18 years.

  • Please indicate if your referral is a crisis situation, which requires immediate contact. Crisis referrals include: callout/support for police interview; callout/support for MEDSAC forensic examination; mental health crisis (e.g. suicide risk).

  • OCASA does NOT accept referrals for perpetrators of harmful sexual behaviour.
